Return, Shipping, and Claims Policy

Original Artworks – National and International Sales

This Return Policy governs all sales made through Salvatore Velardi's official website, artistically known as "Artedelsoffio", concerning original artworks, unique pieces, handmade works, and their national and international shipments.

The purchase of an artwork implies full acceptance of the conditions set forth below.

1. Nature of Works Sold

All works offered are unique original artistic pieces or produced in limited editions, hand-created by the artist.

Any variations in material, color, texture, brushstrokes, or visual details are intrinsic characteristics of the artwork and cannot be considered defects or valid reasons for dispute.

Images published online are for illustrative purposes. Slight differences in color or visual perception may occur depending on the device used by the buyer.

2. General Sales Policy

Except for damages due to transport or errors attributable to the seller, all sales are considered final.

Returns or refunds are not accepted for:

  • buyer's change of mind;

  • subjective aesthetic preferences;

  • incorrect assessment of dimensions;

  • perceptual variations in color or texture;

  • incompatibility with environments or furnishings;

  • buyer's errors in entering shipping data;

  • failure to collect the shipment;

  • claims without verifiable documentation.

3. Right of Withdrawal and Terms

Pursuant to European Directive 2011/83/EU and applicable Italian law, the right of withdrawal provided for distance sales may not apply to original, personalized, custom-made or otherwise non-reproducible works, as they are unique artistic goods not suitable for standard resale.

For any works eligible for the right of withdrawal, the buyer must:

  • communicate the request within 14 days of delivery of the work;
  • await prior written authorization from the seller;
  • return the work within 14 days following confirmation of authorization;
  • use the original, undamaged packaging;
  • ship exclusively via traceable and insured courier.

Return shipping costs are entirely at the buyer's expense, except for errors attributable to the seller or documented damage occurring during transport.

The seller reserves the right to refuse withdrawal requests related to:

  • unique original works;
  • personalized works;
  • artistic commissions;
  • works damaged after delivery;
  • works without an original certificate of authenticity;
  • returns not compliant with these conditions.

4. Shipping of Works

Each work is carefully packaged using professional materials suitable for national and international transport of artworks.

The seller reserves the right to choose the most suitable courier based on:

  • destination;

  • dimensions of the work;

  • transport security;

  • available insurance coverage.

Delivery times are indicative and may vary independently of the seller's will.

5. Works Damaged During Transport

In case of evident damage to the packaging or the work, the buyer is obliged to:

  • sign for delivery with specific reservation;

  • keep all received packaging and materials;

  • send written notification no later than 48 hours from delivery;

  • attach detailed photographs of:

    • the outer packaging;

    • the shipping label;

    • the inside of the package;

    • the damaged work.

Requests lacking the above documentation may be rejected.

6. Claim Verification

Every report will be subjected to technical and documentary verification.

In the event that:

  • damage occurred during transport; or

  • a material error attributable to the seller,

the following may be proposed, at the sole discretion of the seller:

  • replacement of the work (where possible);

  • total or partial refund;

  • credit usable for future purchases;

  • restoration or repair intervention.

7. Unauthorized Returns

Returns shipped independently by the buyer without prior written authorization will not be accepted.

Any unauthorized return shipment may:

  • be refused;

  • or returned to the sender at their expense.

8. Condition of Returned Work

Any returned work must arrive:

  • in its original condition;

  • not installed;

  • not altered;

  • not restored;

  • complete with certificate of authenticity and accompanying documentation;

  • correctly packaged using packaging equivalent to the original.

Any damage subsequent to delivery, tampering, or non-compliant packaging will invalidate any refund request.

9. International Shipments, Duties, and Customs

For non-EU shipments:

  • any customs duties;

  • import VAT;

  • local taxes;

  • customs clearance costs;

  • administrative charges of the destination country;

are entirely the responsibility of the buyer, unless otherwise indicated in writing.

Failure to pay customs duties does not constitute a valid reason for:

  • cancellation of the order;

  • refusal of delivery;

  • refund request.

10. Insurance and Liability

Shipments may be insured according to the availability and conditions of the assigned courier.

The seller's liability ends at the time of delivery as indicated by the official carrier tracking, except for documented damages directly attributable to inadequate packaging or shipping error.

For high-value or large-sized works, specialized art transport couriers may be used.

11. Anti-fraud Protection

To prevent fraud, abusive disputes, or improper use of payment systems:

  • each shipment is photographically documented before dispatch;

  • the condition of the artwork, packaging, and labels are recorded;

  • the seller reserves the right to refuse suspicious orders;

  • any fraudulent behavior will be reported to the competent authorities and payment providers.

12. Certificate of Authenticity

Each original work is accompanied by a certificate of authenticity signed by the artist.

Loss, alteration, or tampering with the certificate subsequent to delivery is not the responsibility of the seller.

13. Jurisdiction and Applicable Law

These conditions are governed by Italian law.

For any dispute relating to the interpretation, validity, or execution of these conditions, the territorially competent court according to applicable current regulations will have jurisdiction.
